Regular Meeting

May 1, 2018

Call To Order – Roll Call: Mayor Jerry Dibble called the regular meeting of the Edgemont Common Council to order at 7:00 p.m. on May 1, 2017, at the Edgemont City Hall. Present were Council members, Terry Leehey, Carl Shaw, Jason Shook, Barbara Strozewski and Sandra Woodward. Carla Schepler was absent.

The Pledge of Allegiance was stated.

Conflict Of Interest For Council Members: No conflicts were heard.

Approval Of Agenda: Sandra Woodward made a motion to approve the May 1, 2018 agenda. Motion seconded by Carl Shaw. Motion passed with unanimous vote.

Approval Of Minutes: Sandra Woodward made a motion to approve the April 17, 2018 minutes. Motion was seconded by Barbara Strozewski. Motion passed with unanimous vote.

Committee Reports: Law Enforcement – Stephen Yenulonis

Public Works Committee – Sandra Woodward 

Finance/Personnel Committee – Sandra Woodward stated that the claims were reviewed and approved.

Mayor – Jerry stated that the first year was a little rough but things were getting better. He also wanted to thank Carl for his service as Councilman. 

Approval Of Claims: Sandra Woodward made a motion to approve the May 1, 2018 claims totaling $48,180.97. Motion seconded by Carl Shaw. Motion carried with unanimous roll call vote.

Council Adjourns for Reorganization at 7:11 p.m.: Carl Shaw made a motion to adjourn for reorganization at 7:11 p.m. Motion was seconded by Sandra Woodward. Motion passed with unanimous vote.

Oaths Of Office: Barbara Strozewski and Robert Worden stated their oaths of office.

Conflict Of Interest For Council Members: Barbara Strozewski stated a conflict with agenda item #8 – Fresh Start Malt Beverage License renewal.

New Business: Election Of Council President: Vote was taken by secret ballot and Sandra Woodward will be the Council President. 

Election Of Council Vice President: Vote was taken by secret ballot and Jason Shook will be the Council Vice-President.

Appoint City Attorney: Mayor Dibble appointed Brian Ahrendt as City Attorney.

Sandra Woodward made a motion to approve the appointment of Brian Ahrendt as City Attorney. Motion was seconded by Barbara Strozewski. Motion passed with unanimous roll call vote.

Appoint Finance Officer: Mayor Dibble appointed Karen Cain as Finance Officer.

Sandra Woodward made a motion to approve the appointment of Karen Cain as Finance Officer. Motion was seconded by Barbara Strozewski. Motion passed with unanimous roll call vote.

Council Committee/Board Appointments: Jason Shook made a motion to approve Mayor Dibble’s Council Committee/Board Appointments as read. Motion seconded by Robert Worden. Motion carried with unanimous roll call vote.

Agreement For Services

Mayor Jerry J Dibble, Mayor of the City of Edgemont on behalf of the City of Edgemont, by and through its City Council as authorized by its vote on May 1, 2018, does appoint Karen Cain as finance officer to provide those services outlined in Edgemont City Ordinance Chapter Five (5).

The parties agree that the term of this Agreement for Services is from May 1, 2018 to May 7, 2019. The parties further agree that this agreement shall only be terminated for good cause or by agreement of the parties.

Resolution 2017-05-02-2: Sandra Woodward made a motion to approve Resolution 2018-05-01-2 as read. Motion seconded by Barbara Strozewski. Motion carried with unanimous roll call vote.

Agreement For Services

Mayor Jerry Dibble, Mayor of the City of Edgemont on behalf of the City of Edgemont, by and through its City Council as authorized by its vote on May 1, 2018, does retain Brian Ahrendt of Sword and Ahrendt Law Office, 702 Jennings Avenue, Hot Springs, South Dakota, 57747 to furnish legal opinions on any matter relating to the affairs of the municipality or the official duties of such officer; conduct the prosecution of all actions or proceedings out of the violation of any ordinance and perform such other professional services incident to the office or as may be required by ordinance, resolution, or directed by the governing body.

The City of Edgemont agrees to pay its attorney $135.00 per hour. In addition the City agrees to pay 42 cents per mile for mileage and 10 cents for copies.

City of Edgemont agrees to pay the billed expenses on a monthly basis upon approval by the City Council.

The City of Edgemont agrees to add the municipal attorney as a named insured under the city’s Liability Insurance, Errors & Omissions Coverage and Legal Defense Coverage.

The parties agree that the term of this Agreement for Services is from May 1, 2018, to May 7, 2019. The parties further agree that this agreement shall only be terminated for good cause or by agreement of the parties.

Edgemont Public Library Annual Report: Sandra Woodward made a motion to approve the Edgemont Public Library Annual Report. Motion seconded by Robert Worden. Motion carried with unanimous roll call vote.

Hat Creek Grill Malt Beverage License Renewal: Jason Shook made a motion to approve the Hat Creek Grill’s Malt Beverage License renewal. Motion seconded by Robert Worden. Motion carried with unanimous roll call vote.

Fresh Start Malt Beverage License Renewal: Sandra Woodward made a motion to approve the Fresh Start’s Malt Beverage License renewal. Motion seconded by Jason Shook. Motion carried with unanimous roll call vote.

Igloo Bar Malt Beverage License Renewal: Sandra Woodward made a motion to approve the Igloo Bar’s Malt Beverage License renewal. Motion seconded by Jason Shook. Motion carried with unanimous roll call vote.

Edgemont Theatre Malt Beverage License Renewal: Sandra Woodward made a motion to approve the Edgemont Theatre’s Malt Beverage License renewal. Motion seconded by Jason Shook. Motion carried with unanimous roll call vote.

Poppy Proclamation: Sandra Woodward made a motion to approve the Poppy Proclamation as read. Motion seconded by Barbara Strozewski. Motion carried with unanimous roll call vote.

Whereas, America is the land of freedom, preserved and protected willingly and freely by citizen soldiers; 

Whereas, Millions who have answered the call to arms and have died on the field of battle;

Whereas, A nation of peace must be reminded of the price of war and the debt owed to those who have died in war;

Whereas, The red poppy has been designated as a symbol of sacrifice of lives in all wars; and

Whereas, The American Legion Auxiliary has pledged to remind America annually of this debt through the distribution of the memorial flower;

Therefore, I, Jerry J Dibble, Mayor of the City of Edgemont, SD do hereby proclaim this 28th day of May, 2018 as POPPY DAY and ask that all citizens pay tribute to those who have made the ultimate sacrifice in the name of freedom by wearing the Memorial Poppy on this day.

Resolution 2018-05-01-3 – Supporting Wildfire Awareness MontH: Sandra Woodward made a motion to approve the Resolution 2018-05-01-3 Supporting Wildfire Awareness Month as read. Motion seconded by Robert Worden. Motion carried with unanimous roll call vote.

Supporting Wildfire Awareness Month

Whereas, the Edgemont City Council is charged with protecting the health and safety of the citizens of Edgemont including all property situated therein; and

Whereas, wildfires threaten the environmental, economic, and social well-being of Edgemont residents while challenging firefighter’s efforts to protect life and property; and

Whereas, the Edgemont City Council has determined that in the interest of public health and safety; and

Whereas, wildfire suppression costs represent only a small portion of overall economic impacts and do not reflect the total cost of catastrophic fires; and

Whereas, residents have the responsibility to recognize the high risk of wildfire and institute safe and early evacuation plans, increase their home’s resistance to wildfire, and create fire adapted communities to increase the safety and survivability of the public and emergency personnel; and

Whereas, Wildfire Awareness Month is an important opportunity for Edgemont residents and all South Dakota’s communities and fire service agencies to reduce the risk of wildfire, increase firefighter safety, and enhance public safety and awareness through education on fire safety, preparation, and prevention; now

Therefore be it Resolved that the Edgemont City Council supports the month of May 2018 as South Dakota Wildfire Awareness Month; and

Therefore be it Further Resolved that the theme for the year, “One Less Spark, One Less Wildfire” is a call for the residents of Edgemont to educate themselves and to take action to reduce the wildfire threat to their homes and help their community move toward becoming a fire adapted community.

Public Comment: George Eberle wants to make sure that the Council will uphold the City Ordinances.
